Terms & Conditions for Service Providers
(Canada Specific)

By accessing and using the Restaserve platform as a service provider or technician, you agree to comply with and be bound by the following terms and conditions. These terms are governed by Canadian laws, including but not limited to privacy, employment, and contract regulations.

Use of Services

Eligibility: You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement.

Account Registration: To access certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

1. Eligibility

To be eligible to use Restaserve as a service provider or technician, you must meet the following criteria:

  • You are legally authorized to work in Canada.
  • You hold any necessary certifications and licenses required to perform the services you offer.
  • You comply with all applicable municipal, provincial, and federal laws in Canada, including but not limited to the Canadian Labour Code, Occupational Health and Safety Regulations, and Consumer Protection Acts.

2. Licensing and Certifications

You must provide valid and current licenses and certifications required to perform maintenance and repair services. It is your responsibility to ensure that all documentation is accurate and up-to-date.

  • Restaserve reserves the right to verify your licenses and certifications with relevant Canadian authorities.
  • Non-compliance with licensing requirements may result in the suspension or termination of your account.

3. Insurance Requirements

Service providers and technicians must maintain valid insurance coverage, including:

  • Commercial General Liability Insurance: to protect against third-party claims for bodily injury and property damage.
  • Workers’ Compensation Insurance: in accordance with the provincial regulations (e.g., WorkSafeBC for British Columbia or WSIB for Ontario).
  • Proof of insurance must be provided upon request, and you agree to maintain coverage during the term of your engagement with Restaserve.

4. Warranties and Service Quality

By agreeing to these terms, you warrant that:

  • All services you provide meet the industry standards and comply with applicable Canadian laws and regulations.
  • You will perform services in a professional, timely, and diligent manner.
  • You will provide accurate invoices and documentation for all completed work.

5. Payment Terms

As-Is: Our Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Warranty: We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

6. Compliance with Canadian Employment and Labour Laws

You agree to comply with Canadian employment standards, which include but are not limited to:

  • Canada Labour Code (if applicable) and provincial employment laws.
  • You acknowledge that as an independent contractor, you are responsible for managing your own taxes, including income tax, GST/HST, and CPP contributions.

7. Data Privacy

By using Restaserve, you agree to the collection and use of your personal and business information in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

  • Your data will be stored and processed securely in accordance with Canadian privacy laws.
  • You may request access to your data or request its removal in compliance with applicable privacy regulations.

8. Dispute Resolution

In the event of any dispute related to the services provided, Restaserve will mediate between you and the restaurant client. However, all disputes will be governed by Canadian contract law and, where applicable, provincial consumer protection laws.

  • Any legal proceedings must be initiated in the jurisdiction where the service was provided, adhering to the rules of the applicable provincial court.

9. Termination of Account

Restaserve reserves the right to terminate your account without notice if:

  • You violate any Canadian laws, regulations, or terms of this agreement.
  • You fail to provide valid insurance, certifications, or licenses.
  • Repeated negative feedback or breach of service quality standards is received.

10. Indemnity

You agree to indemnify and hold harmless Restaserve from any claims, damages, or liabilities arising from:

  • Your breach of these terms and conditions.
  • Any damage to property or injury to individuals resulting from the services you provide.
  • Your failure to comply with Canadian laws and regulations, including employment standards and tax obligations.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Canada, and any disputes arising will be subject to the exclusive jurisdiction of the courts of Canada, with preference given to the province in which the services were provided.

By continuing to use Restaserve as a provider or technician, you agree to these Terms and Conditions and confirm that you are in compliance with all applicable Canadian laws.
